Terms & Conditions

  1. These are the terms and conditions of entry, including information on how to participate and prize details (Conditions of Entry) for the Promotion. Entry into the Promotion is deemed acceptance of these Conditions of Entry.
  2. All entrants acknowledge that the Promoter can rely on these Conditions of Entry in any event.
  3. The Promoter’s decision in relation to any aspect of these Conditions of Entry and the Promotion is final and binding on every person who enters. No correspondence will be entered into.

WHO CAN PARTICIPATE

  1. Entry in the Promotion is open to Australian residents aged 18 years or older who enters via the Facebook Lead Ad Campaign or on tuckersstore.com.au during the campaign period.

  2. The following people are not eligible to enter:
    1. management, employees and directors of the Promoter, its related entities, and other agencies, firms or companies associated with the Promotion; and
    2. a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 8(a) of these Conditions of Entry.

PROMOTION PERIOD

  1. The Promotion will commence at 9:00am Friday 1st March 2024 and conclude at 11:59pm on 30th April 2024.

HOW TO ENTER

  1. To enter the Promotion, the Eligible Entrant must complete the entry form via Facebook or on https://tuckersstore.com.au/equest_equivac_horse_of_the_year and tell us in 25 words or why their horse should be the 2024 Equest Equivac Horse of the Year (Eligible Entry) during the campaign period. The Promoter may determine who is an Eligible Entrant based on these Conditions of Entry in its reasonable discretion.
  2. One (1) Eligible Entry per person per horse submitted. Any multiple entries/entrants, incomplete, ineligible, indecipherable or incorrect entries will be disqualified.

VERIFICATION

  1. Entrants will be subject to verification of purchase by the Promoter. Entrants can only enter the Promotion in their own name; multiple aliases (e.g. multiple names, addresses and/or email addresses) will be disqualified.

GAME OF SKILL AND PRIZE INFORMATION

  1. All Eligible Entries will be judged based on the 25 words or less with two best entries to win 1 of 2 $1000 prizes and the next 20 best entries to receive an Equest & Equivac Horse Health Packs valued at $70 each;
  2. Entries will be judged on 3rd May 2024 at AIRR Derrimut, 1-7 Key West Place, Derrimut, VIC, 3030.
  3. The total value of Prize pool is $3,400, based on 2 x $1,000 per major prize, and 20 x Horse Health Packs valued at $70 each;
  4. The Prize is not exchangeable, transferable or redeemable for cash.

NOTIFICATION OF PRIZE WINNERS

  1. The Prize winners will be announced on the https://tuckersstore.com.au/ page and on Tuckers social pages.
  2. The prizes will be delivered to the winners by AIRR at a time mutually agreed between the winner and AIRR, which will be within 6 weeks of determining the winners. AIRR will pay all delivery costs.

OR Prizes will be available for pick up by the Winner at a Retailer of the Winner’s choice. The prize will be made available to the second and third prize winners within 6 weeks of the draw.

UNCLAIMED PRIZES (IF ANY)

  1. If a winner cannot be contacted within 3 months of the initial notification date of 3th May 2024 a the next best entry will be determined on that date (6th June 2023) at 12 noon from all remaining Eligible Entries.
  2. In the event that the winner is not an eligible person for the purposes of these Terms and Conditions a new winner will be determined from all remaining Eligible Entries.

GENERAL

  1. The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries.
  2. The Promoter reserves the right in its absolute discretion to take any action permitted by law, including cancelling, modifying or suspending the Promotion.
  3. To the extent permitted by law, by entering the Promotion, the entrant releases and indemnifies the Promoter (including its officers, employees and agents) from and against all actions, liabilities, penalties, claims or demands the entrant may have against the Promoter arising out of or in connection with the promotion.
  4. Any entrant who, in the reasonable opinion of the Promoter, engages in any unlawful or improper conduct or beaches these Conditions of Entry will be disqualified.
  5. Except for any liability that cannot by law be excluded, including the Australian Consumer Law, the Promoter, its related entities, employees, agents, directors and contractors, shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including any direct, indirect or consequential loss), without limitation in connection with, or arising from, the Promotion or the acceptance or use of a Prize.
  6. The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of a Prize.
  7. Prize winners must, at the Promoter’s request, participate in any Promotion activity (such as publicity and photography) relating to winning a Prize, free of charge, and they consent to the Promoter using their name, image, captions and comments in any future promotional material, including the Promoter’s website, Promoter’s Instagram, Promoter’s Facebook page or the Promoter’s other website/s without compensation for an indefinite period and entrants agree to co-operate with the Promoter for any such activity.

PERSONAL INFORMATION

  1. All entries are the property of the Promoter after submission by the entrant.
  2. All entry information (Personal Information) may be collected, disclosed and used by the Promoter, its contractors and agents for the purpose of administering this Promotion and contacting the winners and in accordance with the Promoter’s Privacy Policy, which is available at https://www.airr.com.au/privacy-policy/. The Promoter will not disclose entrant’s personal information to any entity outside of Australia. Entrants may access, update or amend their Personal Information by notifying the Promoter.  The Privacy Policy also contains information about how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.

OPTING-IN TO HEAR FROM THE PROMOTER

  1. By submitting an entry in the Promotion and checking the box “Do you approve for AIRR to contact you on News, Product Updates or Promotions?”, entrants agree to their Personal Information being entered into a database and may be used by the Promoter, the Promoter’s related entities, and agencies engaged by the Promoter, for the Promoter’s current and future promotional and marketing purposes including direct marketing in accordance with the Promoter’s Privacy Policy: https://www.airr.com.au/privacy-policy/
  2. Entrants may ‘opt out’ of further promotional or marketing communications from the Promoter by using the ‘opt out’ function on any electronic marketing materials received, or by emailing AIRR at [email protected]
